HANDYBAYANI TERMS AND CONDITIONS

Welcome to HandyBayani, a digital platform that connects customers with independent skilled service providers for home services and other related work. By accessing or using the HandyBayani website, mobile application, or services, you agree to be bound by these Terms and Conditions.

These Terms apply to all users, including Customers and Service Providers.

1. DEFINITIONS

“HandyBayani” refers to the digital platform operated by its owners, administrators, affiliates, and representatives.

“Platform” refers to the HandyBayani website, mobile applications, systems, and related technology.

“Customer” refers to any individual or entity that books or requests services through the HandyBayani platform.

“Service Provider” refers to any independent individual or company offering services through the HandyBayani platform.

“Services” refers to any home service or skilled work offered through the platform, including but not limited to plumbing, electrical work, cleaning, appliance repair, installation, construction work, and other related services.

“Booking” refers to a confirmed request for service made through the HandyBayani platform.

2. PLATFORM ROLE AND LIMITATION OF LIABILITY

HandyBayani is a technology platform that connects Customers with independent Service Providers.

HandyBayani does not employ Service Providers and does not directly perform the services requested.

HandyBayani acts solely as a facilitator and marketplace and therefore:

  • HandyBayani does not guarantee the quality, legality, or suitability of any services provided by Service Providers.
  • HandyBayani is not responsible for the acts, omissions, negligence, or conduct of any Service Provider or Customer.
  • Any agreement for services is solely between the Customer and the Service Provider.

HandyBayani shall not be liable for damages, losses, injuries, or claims arising from services rendered through the platform except where required by applicable Philippine law.

3. USER ACCOUNT REGISTRATION

To use HandyBayani services, users must create an account.

Users agree that:

  • All information provided during registration must be true, accurate, and complete.
  • Users are responsible for maintaining the confidentiality of their login credentials.
  • Users are responsible for all activities conducted through their account.

HandyBayani reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

4. SERVICE BOOKINGS

Customers may request services through the HandyBayani platform.

A booking becomes confirmed when:

  1. The Service Provider accepts the job; and
  2. Payment or booking confirmation is completed through the platform.

Customers agree to:

  • Provide accurate service details.
  • Ensure safe and legal working conditions.
  • Provide reasonable access to the location of the service.

HandyBayani reserves the right to cancel bookings if suspicious activity, fraud, or violations occur.

5. PAYMENT TERMS

Payments may be processed through the platform using approved payment gateways.

Customers agree that:

  • All service fees must be paid according to the agreed price shown in the booking.
  • Additional work outside the booking scope must be mutually agreed upon.

HandyBayani may collect:

  • Platform service fees
  • Processing fees
  • Convenience fees

All fees are non-refundable unless otherwise stated.

6. CANCELLATION POLICY

Customers may cancel bookings subject to cancellation rules.

Possible charges may apply if:

  • The Service Provider is already en route
  • The provider has arrived at the location
  • Cancellation occurs beyond the allowed cancellation period

Service Providers who repeatedly cancel bookings without valid reason may face account penalties or suspension.

7. SERVICE PROVIDER STATUS

Service Providers are independent contractors.

They are not employees, agents, or representatives of HandyBayani.

Service Providers are solely responsible for:

  • Their professional conduct
  • Their workmanship
  • Their tools and equipment
  • Compliance with Philippine laws and regulations
  • Taxes, permits, and licenses

Nothing in these Terms shall create an employment relationship between HandyBayani and the Service Provider.

8. SERVICE WARRANTY AND PAYMENT HOLD POLICY

All Service Providers on the HandyBayani platform expressly warrant the quality, safety, and workmanship of the services they perform.

8.1 Workmanship Warranty

Service Providers agree that all services must be performed:

• in a professional and workmanlike manner

• according to accepted industry standards in the Philippines

• using appropriate tools and materials

• in compliance with applicable safety regulations

The Service Provider shall guarantee the quality of the completed work for the warranty period specified by HandyBayani or the service category.

8.2 Warranty Period

The warranty period shall begin upon completion of the service and confirmation by the Customer in the platform.

The duration of the warranty period may vary depending on the service type and shall be determined by HandyBayani. Example ranges may include:

• Minor repair services – 3 to 7 days

• Cleaning services – 24 to 72 hours

• Installation services – 7 to 30 days

• Major repair or construction services – up to 90 days

HandyBayani reserves the right to modify warranty periods depending on service categories.

8.3 Payment Hold / Escrow Protection

To ensure service quality and protect customers, HandyBayani may temporarily hold the payment for services rendered during the warranty period.

Under this system:

    1. Payments made by Customers may be held in escrow by the platform.
    2. The held amount will be released to the Service Provider only after the warranty period has expired, provided that no valid dispute or complaint has been filed.
    3. If a valid service complaint is filed during the warranty period, HandyBayani may temporarily suspend payment release while the issue is investigated.

This mechanism ensures accountability and service reliability across the platform.

8.4 Defective Work and Service Remedies

If a Customer reports that the service performed is defective or incomplete during the warranty period, the Service Provider shall be required to:

• return to correct the issue, or

• redo the service at no additional cost, or

• provide a partial or full refund if remediation is not possible.

Failure of the Service Provider to honor warranty obligations may result in:

• withholding of payment

• refund to the Customer

• account suspension or termination

8.5 Platform Mediation

HandyBayani may assist in resolving disputes between Customers and Service Providers.

However, HandyBayani:

• does not guarantee outcomes of disputes

• does not assume liability for the workmanship of Service Providers

The Service Provider remains fully responsible for the services performed.

8.6 Release of Funds

If no complaint is filed within the warranty period, the held payment shall automatically be released to the Service Provider.

Customers acknowledge that failure to report issues within the warranty period shall be deemed acceptance of the service performed.

8.7 Fraudulent Claims

If a complaint is determined to be fraudulent or made in bad faith, HandyBayani reserves the right to:

• release payment to the Service Provider

• suspend or terminate the Customer’s account

9. SERVICE PROVIDER RESPONSIBILITIES

Service Providers agree to:

  • Provide truthful information about their qualifications
  • Maintain professional conduct
  • Deliver services as described in their listings
  • Respect the safety and property of customers
  • Comply with applicable laws

Service Providers must not:

  • Perform illegal activities
  • Use abusive behavior
  • Misrepresent their skills or certifications

Violation may result in account suspension or permanent removal from the platform.

10. INSURANCE AND LIABILITY

HandyBayani may partner with insurance providers to offer optional protection.

However:

  • Service Providers remain fully responsible for damages caused by their work.
  • Customers agree that HandyBayani is not liable for property damage or personal injury caused by Service Providers.

Users are encouraged to verify insurance coverage when applicable.

11. DISPUTE RESOLUTION

In case of disputes between Customers and Service Providers:

  1. Both parties are encouraged to resolve the issue amicably.
  2. HandyBayani may provide mediation support.
  3. HandyBayani may suspend accounts pending investigation.

HandyBayani reserves the right to make final decisions regarding platform usage privileges.

12. USER CONDUCT

Users must not:

  • Use the platform for illegal purposes
  • Harass or threaten other users
  • Circumvent the platform to avoid platform fees
  • Upload false or misleading information

Violation may result in account suspension or legal action.

13. RATINGS AND REVIEWS

Customers may leave ratings and reviews.

Reviews must be:

  • Honest
  • Non-defamatory
  • Based on actual service experiences

HandyBayani reserves the right to remove inappropriate reviews.

14. PLATFORM FEES

HandyBayani may charge Service Providers:

  • Commission fees
  • Subscription fees
  • Lead generation fees

Fees may change with prior notice.

15. INTELLECTUAL PROPERTY

All platform content including:

  • logos
  • branding
  • software
  • designs

remain the property of HandyBayani.

Users may not copy, reproduce, or distribute platform materials without permission.

16. TERMINATION OF ACCOUNT

HandyBayani may suspend or terminate accounts for:

  • Fraud
  • Repeated cancellations
  • Poor service quality
  • Abuse of the platform
  • Violation of these Terms

Termination may occur without prior notice if necessary.

17. DATA PRIVACY

HandyBayani complies with the Philippine Data Privacy Act of 2012 (RA 10173).

User data will be collected and processed only for purposes necessary to operate the platform.

Personal information will not be sold to third parties without consent except as required by law.

18. FORCE MAJEURE

HandyBayani shall not be liable for failure to perform obligations due to circumstances beyond reasonable control including:

  • natural disasters
  • government actions
  • internet outages
  • pandemics

19. AMENDMENTS TO TERMS

HandyBayani reserves the right to update these Terms at any time.

Users will be notified through:

  • app notifications
  • website updates
  • email

Continued use of the platform constitutes acceptance of the revised Terms.

20. GOVERNING LAW

These Terms shall be governed by the laws of the Republic of the Philippines.

Any legal disputes shall be filed in the proper courts within the Philippines.
