HandyBayani App Terms and Conditions

Welcome to HandyBayani! These Terms and Conditions ("Terms") govern your use of the HandyBayani mobile application (the "App") provided by HandyBayani, Inc. ("HandyBayani", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. Please read them carefully before using the App.

1. Acceptance of Terms: By accessing or using the App, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

2. Use of the App: You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years old. You may use the App only for lawful purposes and in accordance with these Terms.

3. User Accounts: To use certain features of the App, you may be required to create an account. You agree to provide accurate and complete information when creating your account and to update your information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Content: You may have the opportunity to post, submit, or otherwise provide content through the App ("User Content"). You retain ownership of your User Content, but by providing it, you grant HandyBayani a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your User Content in any media.

5. Prohibited Conduct: You agree not to engage in any of the following prohibited activities:

   - Violating any applicable law or regulation;

   - Posting or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;

   - Interfering with or disrupting the operation of the App;

   - Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity;

   - Collecting or storing personal data about other users without their consent;

   - Engaging in any other conduct that restricts or inhibits anyone’s use or enjoyment of the App.

6. Intellectual Property: The App, including all content, features, and functionality, is owned by HandyBayani or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not modify, reproduce, distribute, or create derivative works based on the App.

7. Third-Party Links: The App may contain links to third-party websites or resources. HandyBayani is not responsible for the content or practices of any third-party websites or resources. You acknowledge and agree that HandyBayani is not liable for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or resources.

8. Disclaimer of Warranties: THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. HANDYBAYANI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability: IN NO EVENT SHALL HANDYBAYANI OR ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

10. Indemnification: You agree to indemnify and hold HandyBayani and its directors, officers, employees, and agents harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App or your violation of these Terms.

11. Modification of Terms: HandyBayani reserves the right to modify or revise these Terms at any time, with or without notice. Your continued use of the App following the posting of any changes to these Terms constitutes acceptance of those changes.

12. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Philippines. Any legal action or proceeding arising out of or related to these Terms or the App shall be brought exclusively in the courts of the Philippines.
